Arctic Wolfe LLC, we have restated the definition as follows:
Liability
Arctic Wolfe LLC will not be liable to you for any special, indirect,
consequential, punitive, or incidental damages (including, without
limitation, damages for loss of business profits, business interruption,
loss of business information, or any other pecuniary loss) arising out
of the use of or inability to use this product. Your entire liability
and your exclusive remedy shall be no more than the amount paid for the
particular product. Your rights may vary from state to state.
Breach of Agreement
You agree to indemnify and hold Arctic Wolfe LLC and its successors harmless
from and against any damages or liability of any kind arising from your
use of the product in any form, any breach of the terms and conditions
of this Agreement, or your negligent act, omission or willful
misconduct. If any part of this Agreement is found void and
unenforceable, it will not affect the validity of the balance of the
agreement, which shall remain valid and enforceable according to its
terms. All license rights granted pursuant to this Agreement shall
automatically terminate upon your breach of this Agreement.
No Representation
Arctic Wolfe LLC has not made any representation or warranty as to the
accuracy or completeness of this information. Arctic Wolfe LLC will not have
any liability to arising from the delivery of use of the information,
except to the extent expressly set forth in any definitive written
agreement that parties may execute in the future. The financial
performance of the ice house or ice houses which is/are the subject of
future Agreements will depend entirely on the buyer's efforts to select
a suitable location and promote and manage the ice house or ice houses;
and Arctic Wolfe LLC makes no promise that an Ice House will meet or exceed
the performance of the Ice Houses which are the subject of the pro-forma
information disseminated by Arctic Wolfe LLC.
